Scope of Terms and Conditions.

The Terms and Conditions of product sales and service projects are limited to those contained herein. Any additional or different terms or conditions in any form delivered by you (“Customer”) are hereby deemed to be material alterations and notice of objection to them and rejection of them is hereby given. By accepting delivery of the products or by engaging Vernon BC Air Conditioning Inc. (“Seller”) to provide product(s) or perform or produce any services, Customer agrees to be bound by and accepts these Terms and Conditions unless Customer and Seller have signed a separate agreement, in which case the separate agreement will govern. These Terms and Conditions constitute a binding contract between Customer and Seller and are referred to herein as either “Terms and Conditions” or this “Agreement.” Customer accepts these Terms and Conditions by making a purchase from or placing an order with Seller or engaging Seller to perform or procure any services. These Terms and Conditions are subject to change without prior notice, except that the Terms and Conditions posted on Seller’s Site at the time Customer signs the Installation Proposal will govern, unless otherwise agreed in writing by Seller and Customer.
Payment Terms. Customer shall pay Seller according to the terms contained in the Installation Proposal. Final payment shall be due after the work described in the Installation Proposal is substantially completed.

Zoning and Permits.

Customer agrees to timely furnish all information necessary to secure plans and permits for the work called for under this Agreement, and Customer warrants the work contracted for to be in compliance with applicable zoning, classification, and building codes. Any costs for work not in the Estimate but required by lawful authorities to bring the work into compliance with applicable code shall be the responsibility of the Customer. Seller assumes no responsibility for violation of zoning rules/laws.

Change Orders.

During the progress of the work under this Agreement, if Customer should order extra work not specified in the Agreement, Seller may require such extra work to be considered an agreement separate and aside from this Agreement and may require payment for said extra work in advance.

Work Schedule.

Work shall be completed within a reasonable time. Performance of this Agreement is subject to labor strikes, fires, acts of war or terrorism, acts of God, adverse weather conditions not reasonably anticipated, unusual delays in transportation, Seller’s ability to obtain materials, and/or any cause beyond Seller’s control.

Substitutions.

Should Seller be unable to obtain any material(s) specified in the Agreement or any Change Order, Seller shall have the right at its sole discretion to substitute comparable materials, and such substitution shall not affect the Contract Price.

Excess Materials.

Extra materials left over upon completion shall be deemed Seller’s property, and Seller may enter upon the Property's premises to remove excess material(s) at all reasonable hours.

Supervision Responsibility.

Seller shall supervise and direct the work at Customer’s Property, using reasonable skill and attention. Seller shall be solely responsible for the construction means, methods, technique, sequences, and procedures for all work performed at Customer’s Property pursuant to this Agreement. Customer shall not interfere with Seller’s work forces or Seller’s subcontractors.

Limited Warranty.

Seller shall provide Customer with a limited warranty on service and labor for the duration set forth in the Installation Agreement, beginning on the date of completion of services against defects in the quality of workmanship and/or materials (“Warranty Period”). Seller shall not be liable during or following the Warranty Period for any: (a) damage due to ordinary wear and tear or abusive use; (b) damage due to use of the equipment beyond the design temperatures (cooling set below 70°F, for instance); (c) defects that are the result of characteristics common to the materials used; (d) loss, injury or damages caused in any way by the weather elements; (e) conditions resulting from condensation on, or expansion or contraction or, any materials; (f) any water leak, blockage, freezing, or other malfunction of condensate or drain lines; and/or (g) air leaks arising from structural deficiencies within existing supply/return ducts or transitions. If Customer opts for a Warranty Period exceeding two (2) years, Customer agrees to maintain yearly service agreements with Seller for the entire duration of the Warranty Period; Seller shall not be liable for warranty repairs during the Warranty Period in the absence of such yearly service agreement(s). If the Customer sells the home then the equipment will default to base warranty of 5 years parts and 5 years labor (assuming maintenance agreement is keep current). If applicable, Customer is responsible for paying equipment manufacturer for any transfer of equipment warranty. Seller is not responsible for any warranties provided by the manufacturer. Seller makes no warranty to Buyer regarding materials and/or equipment installed (other than a warranty of title), and Seller authorizes no third person or party to assume any warranty obligation or liability on Seller’s behalf. The only warranties applicable to the materials and/or equipment installed are those, if any, extended by the respective manufacturer that shall furnish to Buyer any and all applicable warranty documents. Seller hereby assigns to Buyer, without recourse, any applicable warranties extended to Seller. Such assignment shall constitute Seller’s sole obligation and Buyer’s sole exclusive remedy from Seller with regard to defective materials and/or equipment installed. This limited warranty is in lieu of all other warranties, statutory or otherwise, express or implied, all representations made by Seller, and all other obligations or liabilities respective of the Services provided at the Property. Seller disclaims all other warranties, express or implied, including without limitation any implied warranty of workmanlike construction, implied warranty of habitability, implied warranty of fitness for a particular purpose or use, and/or implied warranty of merchantability. Under no circumstances shall Seller be liable to Customer for loss of time, loss of use, inconvenience, or any other incidental or consequential damages that may arise from this Agreement. Unauthorized repairs or attempted repairs shall void this warranty entirely.

Waiver. 

The failure of either party to enforce any provision of this Agreement shall not be deemed a waiver of future enforcement of that or any other provision. No waiver of any provision of this Agreement shall be effective unless in writing and signed by the waiving party.

Governing Law.

This Agreement shall be governed by and construed in accordance with the laws of the province of British Columbia, Canada, without regard to its conflict of laws principles. Any dispute arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the courts located in Vernon, British Columbia.

Assignment.

Customer may not assign or transfer this Agreement, in whole or in part, without the prior written consent of Vernon BC Air Conditioning Inc. Any attempted assignment or transfer without such consent shall be null and void. Vernon BC Air Conditioning Inc. may freely assign or transfer this Agreement without Customer's consent.

Notices.

All notices, requests, demands, and other communications under this Agreement shall be in writing and shall be deemed to have been duly given if delivered personally, sent by registered mail with return receipt requested, or sent by email or other electronic means to the parties at their respective addresses or email addresses as set forth in the Installation Proposal or as subsequently modified by written notice.

Relationship of the Parties.

The relationship between Customer and Vernon BC Air Conditioning Inc. is that of independent contractors. Nothing in this Agreement shall be construed as creating a partnership, joint venture, agency, employment, or franchise relationship between the parties. Neither party shall have the authority to bind or obligate the other party in any manner.

Survival.

The provisions of this Agreement that by their nature are intended to survive termination or expiration of this Agreement shall survive, including but not limited to the provisions relating to payment, warranty, indemnification, insurance, and limitation of liability.

Counterparts.

This Agreement may be executed in counterparts, each of which shall be deemed an original, but all of which together shall constitute one and the same instrument.

Headings.

The headings in this Agreement are for convenience only and shall not affect the interpretation of this Agreement.

Amendments.

This Agreement may not be amended or modified except by a written instrument executed by both Customer and Vernon BC Air Conditioning Inc.

Interpretation.

In the event of any ambiguity or inconsistency between the provisions of this Agreement and any related documents or attachments, the provisions of this Agreement shall prevail.

100% Satisfaction Guarantee Terms and Conditions

If for any reason you aren't fully satisfied with the equipment or the service we provide, we will, with reasonable requests, either repair the issue or replace the equipment, with the following terms and conditions:

Full refund guarantee does not apply to specialty or custom parts or equipment. We will replace equipment found to be faulty within 90 days of the installation date.

Issues with service or equipment must be deemed by Vernon Bc Air Conditioning Inc as reasonable.

If your equipment warranty has been registered then we cannot return the equipment so only repairs would be accepted.

We reserve the right to decline any return requests as we see fit.
Maximum refund per order or customer is $5000. The only remedy for problems with orders over $5000 is replacement of the equipment by us or to correct product defects. We are always reasonable to work with you on orders of any size, but the lawyers made us put this part in to protect ourselves from possible fraud.

This guarantee is limited to replacement of the original order quantity or refund of the purchase price of the order. We are not responsible for any damages or claims incurred by you or your business caused by receiving parts or equipment which are defective or incomplete or which you receive later than the estimated delivery date.

This guarantee does not cover fees for mailing service or postage or associated incidental or consequential damages or claims. Vernon Bc Air Conditioning Inc. is not liable for manufacturer/supplier errors, including loss or delay.

Cancellation Policy – Vernon Air Conditioning, Plumbing and Electrical Services

Cancellations made 48 hours or less before an appointment will be subject to a charge of 75% of the service rate for the quantity of hours that were booked (ex. a four hour appointment at $120 an hour would have a cancellation fee of $360). This includes appointments where our service provider is unable to access the property, is turned away, or the client is unavailable.

If Vernon Air Conditioning, Plumbing and Electrical Services cancels an appointment with less than 48 hours notice, a new appointment will be scheduled without penalty to the client, subject to availability.

Vernon BC Air Conditioning Inc. Referral Program Terms and Conditions

1. Introduction
1.1. These terms and conditions ("Terms") govern your participation in the Vernon BC Air Conditioning Inc. Referral Program ("Program"). By participating in the Program, you agree to comply with these Terms. Please read them carefully.
2. Eligibility
2.1. To be eligible to participate in the Program, you must be a current customer of Vernon BC Air Conditioning Inc. ("Referrer"). The Program is open to individuals and businesses.
3. How the Program Works
3.1. Referrer can refer friends, family members, or colleagues ("Referee") to Vernon BC Air Conditioning Inc., and if the Referee makes a qualifying purchase or takes a specific action as defined by Vernon BC Air Conditioning Inc., both Referrer and Referee may be eligible to receive rewards, discounts, or incentives as outlined by Vernon BC Air Conditioning Inc.
3.2. The specifics of the referral program, including the rewards and qualifying actions, are subject to change at Vernon BC Air Conditioning Inc.'s discretion. Vernon BC Air Conditioning Inc. will communicate any changes to the Program on its website or through email.
4. Referral Links
4.1. Vernon BC Air Conditioning Inc. may provide Referrer with unique referral links or codes to share with Referees. These links or codes are to be used exclusively for the Program.
5. Eligible Referrals
5.1. To be eligible for rewards or incentives, Referee must:
a) Be a new customer to Vernon BC Air Conditioning Inc.
b) Sign up or make a qualifying purchase using the referral link or code provided by the Referrer.
c) The referral must be referenced by the new customer on the original interaction with Vernon Bc Air Conditioning Inc.
6. Rewards and Incentives
6.1. The rewards and incentives for successful referrals will be determined by Vernon BC Air Conditioning Inc. and may be subject to change. Vernon BC Air Conditioning Inc. will communicate the current rewards structure to Referrers.
6.2. Rewards may be in the form of discounts, credits, gift cards, or other incentives, as determined by Vernon BC Air Conditioning Inc.
7. Limitations
7.1. Referrer may not refer themselves or create multiple accounts to accrue rewards.
7.2. Referrer may not engage in any fraudulent or deceptive practices to gain referrals.
8. Termination and Modification
8.1. Vernon BC Air Conditioning Inc. reserves the right to terminate, modify, or suspend the Program at any time without notice.
9. Privacy
9.1. By participating in the Program, Referrer and Referee consent to the collection and use of their personal information by Vernon BC Air Conditioning Inc. as described in Vernon BC Air Conditioning Inc.'s Privacy Policy.
10. General
10.1. These Terms are governed by the laws of British Columbia, BC. Any disputes arising from or related to the Program shall be resolved in the courts of British Columbia, BC.
10.2. Vernon BC Air Conditioning Inc.'s failure to enforce any provision of these Terms shall not constitute a waiver of that provision.
10.3. These Terms constitute the entire agreement between the parties regarding the Program and supersede all prior and contemporaneous a

Furnace Filter Sales Terms and Conditions


Eligibility: This program is available to all customers of Vernon Air Conditioning, Plumbing, and Electrical Services (hereafter referred to as "Vernon Services").


Program Purpose: The furnace filters are offered at our cost as a service to our customers to ensure the efficient operation of their HVAC systems. These filters are intended for personal use only.


Non-Resale: Purchased filters under this program are not for resale. Customers agree to use the filters solely for the purpose of maintaining their HVAC systems serviced by Vernon Services.


Pick-Up/Shipping: Customers can either pick up the filters directly from our office, shipping or delivery is not an available option. 


Limitations: Each customer is entitled to purchase a quantity of filters appropriate for one year of use per HVAC unit, as recommended by the manufacturer’s guidelines.


Returns and Exchanges: Due to the at-cost nature of this program, all sales are final. Returns or exchanges of filters are not allowed unless the product is defective upon receipt.


Product Warranty: Vernon Services does not provide additional warranties for the filters beyond any existing manufacturer's warranty. Customers should contact the manufacturer directly for any warranty claims.


Liability: Vernon Services shall not be liable for any damages or issues arising from the use of purchased filters, including but not limited to, incorrect installation or compatibility issues.


Changes to Terms: Vernon Services reserves the right to modify these terms and conditions at any time without prior notice. Continued participation in the program following any changes constitutes acceptance of the new terms.


Termination: Vernon Services reserves the right to terminate the program or an individual's participation in it at any time, for any reason, including abuse of the program terms.


Acceptance of Terms: By purchasing furnace filters under this program, customers acknowledge they have read, understood, and agreed to these terms and conditions.

Furnace Filter Sales Terms and Conditions


Eligibility: This program is available to all customers of Vernon Air Conditioning, Plumbing, and Electrical Services (hereafter referred to as "Vernon Services").


Program Purpose: The furnace filters are offered at our cost as a service to our customers to ensure the efficient operation of their HVAC systems. These filters are intended for personal use only.


Non-Resale: Purchased filters under this program are not for resale. Customers agree to use the filters solely for the purpose of maintaining their HVAC systems serviced by Vernon Services.


Pick-Up/Shipping: Customers can either pick up the filters directly from our office, shipping or delivery is not an available option. 


Limitations: Each customer is entitled to purchase a quantity of filters appropriate for one year of use per HVAC unit, as recommended by the manufacturer’s guidelines.


Returns and Exchanges: Due to the at-cost nature of this program, all sales are final. Returns or exchanges of filters are not allowed unless the product is defective upon receipt.


Product Warranty: Vernon Services does not provide additional warranties for the filters beyond any existing manufacturer's warranty. Customers should contact the manufacturer directly for any warranty claims.


Liability: Vernon Services shall not be liable for any damages or issues arising from the use of purchased filters, including but not limited to, incorrect installation or compatibility issues.

Neighborhood Buying Group / Purchase Program Terms and Conditions


Eligibility: Participation in the Vernon Air Conditioning, Plumbing, and Electrical Services Neighborhood Buying Group Purchase Program ("Program") is open to residential homeowners in designated neighborhoods. Commercial properties are excluded.


Group Formation: Participants must join a neighborhood group to qualify for bulk purchase discounts. A minimum of 10 participants per neighborhood is required to activate the group discount.


Product Selection: Participants may choose from a pre-selected range of water heaters, subject to availability. Vernon Services reserves the right to substitute products of equal or greater value based on stock availability.


Pricing and Payment: Discounted pricing will be disclosed to participants once the minimum group size is met. Prices include installation by certified professionals. Full payment is required upon order confirmation.

Exclusions:

Sinister Intentions: We reserve the right to deny any customer's participation in the Promotion if we suspect the intention, by either the customer or another contractor, is to exploit this offer maliciously or fraudulently.


Single Home Residential Installations Only: This Promotion is limited to single home residential installations. It does not apply to commercial, multi-family units, or new construction projects.


Proof of Payment Requirement: In the event that we cannot beat a competitor's quote by at least 5%, you must provide us with a copy of the competitor's invoice showing that payment was made, at the original quoted price, to qualify for the $50 offer.


Promotion Restrictions: This Promotion cannot be combined with any other offers, discounts, or promotions. We reserve the right to modify or cancel this Promotion at any time without notice.
